1. Acceptance of Terms

By accessing phenolens.com or using any Phenolens service, you agree to be bound by these Terms of Use. If you do not agree, please do not use this website or any associated services.

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Coimbatore, Tamil Nadu.

2. About Valyria Visions

Valyria Visions Pvt. Ltd. is a private limited company incorporated under the Companies Act 2013, with its registered office at COXBIT Incubation Centre, Tamil Nadu Agricultural University, Coimbatore – 641003, Tamil Nadu, India.

3. Nature of the Service — Important Disclaimer

Phenolens outputs are satellite-derived intelligence reports intended as advisory inputs to support decision-making. They are NOT:

  • Loan sanction decisions or financial advice
  • Insurance claim approvals or rejections
  • Legal evidence or certified measurements
  • A substitute for required regulatory procedures (including CCE under PMFBY)
  • Professional agronomic advice

All credit, insurance, or business decisions made using Phenolens outputs remain the sole responsibility of the user. Valyria Visions Pvt. Ltd. is not liable for any decision made in reliance on Phenolens outputs.

4. Accuracy and Limitations

Phenolens outputs are derived from satellite data and modelling. While we design our systems for accuracy and disclose confidence tiers, limitations, and data dates on every report, satellite-derived data is inherently subject to:

  • Satellite revisit and cloud-cover constraints
  • Plot size effects on index reliability
  • Crop type and regional calibration limitations

5. Intellectual Property

All content on phenolens.com — text, graphics, methodology descriptions, report formats, code, and design — is the property of Valyria Visions Pvt. Ltd. and is protected under Indian copyright law. Satellite data sources (Sentinel-2, Sentinel-1, MODIS) are used under their respective open access policies (ESA Copernicus, NASA Earthdata) and remain the property of the issuing agencies.

You may not reproduce, distribute, or create derivative works from Phenolens content without prior written permission.

6. Prohibited Uses

You may not:

  • Use Phenolens outputs as sole basis for denying financial services without additional due diligence
  • Reverse-engineer, scrape, or attempt to extract the underlying models or algorithms
  • Represent Phenolens outputs as government-certified yield estimates
  • Use the platform for any unlawful purpose

7. Limitation of Liability

To the maximum extent permitted by applicable law, Valyria Visions Pvt. Ltd. shall not be liable for any indirect, incidental, consequential, or special damages arising from use of or reliance on Phenolens services. Our total liability for any claim arising from use of the platform shall not exceed the amount paid by you for the service in the preceding 3 months.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act 1996, with a sole arbitrator, conducted in English, seated in Coimbatore, Tamil Nadu.

9. Changes to Terms

We may update these Terms at any time. Material changes will be notified via the website. Continued use after changes constitutes acceptance.
